1Agreeing to these terms
These Terms and Conditions ("Terms") are an agreement between you and MDB Bookkeeping, 25 Park Ave, Monroe, NY 10950 ("we", "us" or "our"), which owns and operates My Clear Finance (the "App"), including the website at myclearfinance.com.
By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App.
2Who can use the App
You must be at least 18 years old and able to enter into a binding agreement to use the App. If you add family members to your household, you are responsible for their use of it.
3Your account and access
You need an account to use the App. Please give us accurate information, keep your sign-in details private, and tell us right away if you think someone else has used your account. You are responsible for what happens under your account.
Access to the App, or to some features, may be by invitation only, or limited while we are in early access. We may decide who gets access and may change or end an invitation at any time.
4Bank connections through Plaid
If you choose to connect a bank or card account, the connection is made through Plaid Inc. ("Plaid"), a third-party service. You sign in to your bank inside Plaid's secure window. We never see or store your bank username or password.
Bank connections are read-only. The App can read information such as balances, accounts and transactions. It cannot move money, make payments or make any changes at your bank.
By connecting an account, you allow us and Plaid to collect and use your information from your bank as described in our Privacy Policy, and you agree that Plaid's collection and use of your information is governed by the Plaid End User Privacy Policy. You can disconnect a bank at any time in the App.
Information from your bank may sometimes be late, missing or wrong. Always check your bank's own records before you make a decision.
5Not financial, tax or legal advice
My Clear Finance is a tool to help you organize and understand your money. We are not a bank, lender, broker, financial adviser, accountant, tax preparer or law firm, and we do not hold or move your money.
Budgets, maaser and gemach totals, goals, forecasts and reports in the App are estimates for your own planning. The Financing Coach uses artificial intelligence to answer questions based on the information in your account. Its answers are for general information only, can be incomplete or wrong, and are not personal financial, investment, tax, legal or halachic advice. For important decisions, please speak to a qualified professional or your Rav.
6Plans, free trial, billing and cancellation
The App offers a Free plan and may offer paid plans, such as Plus. Prices, features and billing periods (monthly or yearly) are as shown at signup or in the App before you buy.
A paid plan may start with a 7-day free trial. If you do not cancel before the trial ends, your plan starts and you will be charged the price shown at signup. Paid plans renew automatically at the end of each billing period until you cancel. Payments are handled by a third-party payment processor.
You can cancel at any time. Your paid features stay on until the end of the period you already paid for, and you will not be charged again. Payments are not refundable, and we do not give refunds or credits for partly used periods, except where the law requires it or where we decide to at our discretion.
We may change our prices or plans. If a price change affects your paid plan, we will tell you before it takes effect, and you can cancel before you are charged the new price.
7Using the App fairly
Please use the App only for your own personal or household use, and only in lawful ways. You agree not to:
- use someone else's account or bank details without permission
- upload anything illegal, harmful or that you have no right to share
- try to break, hack, overload or get around the security of the App
- copy, scrape, resell or reverse-engineer the App or its content
- use the App or the Coach to harm, cheat or mislead anyone
8Your data and privacy
Your information belongs to you. Our Privacy Policy explains what we collect, how we use it, who we share it with, and how you can ask us to delete it. We do not sell your personal information.
You give us permission to store and process the information you add to the App, or that comes in through a connected bank, only so we can run the App and provide it to you.
9Our App and content
The App, its design, text, graphics, logos and software belong to us or our licensors and are protected by law. We give you a personal, limited, non-transferable right to use the App under these Terms. "My Clear Finance" and our logo may not be used without our written permission.
If you send us ideas or feedback, we may use them freely without paying you.
10Disclaimers
We work hard to keep the App accurate, safe and available, but it is provided "as is" and "as available". To the fullest extent the law allows, we do not promise that the App will always work without errors or interruptions, that information in it will be complete or accurate, or that it will meet your needs. Some features depend on third parties, such as Plaid and your bank, and we are not responsible for their services.
11Limits on our responsibility
To the fullest extent the law allows, we will not be responsible for any indirect, incidental, special or consequential losses, or for lost money, profits or data, that come from your use of the App or from decisions you make based on it.
Our total responsibility to you for any claim about the App is limited to the greater of the amount you paid us in the 12 months before the claim, or $50.
Some places do not allow these limits, so they may not all apply to you.
12Ending your account
You can stop using the App and ask us to close your account at any time by writing to office.mdbbookkeeping@gmail.com.
We may suspend or close your account if you break these Terms, if we must for legal or security reasons, or if we stop offering the App. Where it is reasonable, we will tell you first. Sections that by their nature should continue after your account ends, such as disclaimers and limits on responsibility, will continue.
13Changes to these terms
We may update these Terms from time to time. When we do, we will change the date at the top of this page, and for important changes we will let you know in the App or by email. If you keep using the App after the changes take effect, you accept the new Terms.
14Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute about these Terms or the App will be handled in the state or federal courts located in Orange County, New York, and you and we agree to those courts.
